Permanent Residency for Short-Term Stream TSS 482 Visa Holders

Australian immigration processes and laws are changing, and the role of immigration agents stands as a guiding advisor and support system. However, amidst the vast sea of information, it has come to light that not all overseas workers are receiving the accurate counsel they deserve. Particularly during the pandemic, a significant revelation emerged – a pathway to permanent residency exists for those who have held two short-term TSS 482 visas. What's more, this pathway isn't contingent upon forthcoming legislation in December 2023; eligible candidates are already poised on the threshold of permanent residency.

The Pathway

This unique allows access to the Temporary Residence Transition stream of the ENS 186 visa for short-term stream TSS 482 visa holders who:

  1. Spent at least 12 months in Australia between 1 February 2020 and 14 December 2021; and

  2. Meet all other nomination and visa requirements for the TRT stream of the ENS visa – i.e. must have spent three (3) years in the same position over two short-term TSS 482 Visas.

This means that a large number of TSS 482 visa holders in the short-term stream either have, or will have access to a Permanent Residency pathway without awaiting the expected legislative changes from the Government.

Further Concession

In addition to the above in calculating the 3 years required to apply for the Temporary Residence Transition stream of the ENS 186 Visa, thew following are also included:

  1. a bridging visa granted on the basis that the nominee is an applicant for TSS 482 Visa, or

  2. a bridging visa granted on the basis that the nominee being ian applicant for an ENS visa or RSMS visa.

In effect, one can include all of their time from the lodgement of their first short term TSS 482 Visa, provided they were onshore and automatically granted a Bridging Visa following receipt and acknowledgement of their application.
